Terms and conditions for Families

1-After the family fills and sends in the registration form. They will receive a confirmation email within a few days. We will contact you make for an interview in your home and inspect your sanitary facilities and the Au pair’s room.
2-By signing the registration form, the family agrees with the operative term of condition of Babs Au pair Agency
3-The client refers to a person/s or company who engages The Agency to seek a suitable Au pair for an agree fee.
4-Registration is free of charge and open for one year.
5- All the documents and information submitted will be treated as confidential and remain the property of Babs Au pair Agency.
The interview is free within a 150 km radius of Apeldoorn . Outside the 150 km zone there is an additional charge of € 0, 30 cent per km.
6-Babs Au pair Agency will search for a suitable Au pair, usually it is possible to choose from several resumes. If not, we will contact our colleagues abroad to continue searching.
7-We don’t accept cheques.
8-Accounts are strictly payable within 8 days of the invoice date. Babs Au Pair preserves the right to charge interest on late payments on the full invoice (excluding VAT and accrued interest) at the rate 5% per month from the due date.
If the client doesn’t (want to) pay the fee to Babs Au Pair Agency and there is need for a payment collection Agency (Deurwaarden), a claim for a refund will not be considered by Babs Au pair Agency.
9-The client has a trial period for 3 months for Au pair. If the Au pair leave within 3 months for whatever reason, client will get mediation for a new au pair. If the new Au pair leaves after 3 months, program fee have to be paid again.
10-If is not more than 18 months have passed since the last Au pair’s departure and a new mediation is done, the client will receive 10% deduction on placing fee.
11-When the last mediation is more 18 months since the last Au pair, than a new interview will be needed.
12-Board and Accommodation
12.1 The family is responsible for board, accommodation and for giving the Au pair pocket money as confirmation in application form.
12.2 The family should arrange for the Au pair to attend a language course.
12.3 The family has the responsibility for what they write in the application from and there Dear Au pair letter of acceptation.
12.4 The family is responsible for meeting their Au pair at their point of entry into the Holland.
12.5 The family is the responsibility to protect the Au pair from accident and illness by mean of comprehensive home insurance.
13. Liability
13.1 Any contract between the agency and the family is subject to the low of Holland and all disputes arising out of any such contract shall be subject to the exclusive jurisdiction of the courts of Holland
13.2 The family is responsible for travel expenses to and from Holland.
14-The client need to fill out the application form completely and accurately.
15-The client needs to adhere to all out rules as is described under “ What is an Au pair?” and “what does an Au pair do”?.
16-Babs Au pair Agency is not liable for any discomfort, loss and/or damage to property. Babs Au pair Agency is not liable for injuries related directly or indirectly to acts on purpose or negative behavior of the candidate who was placed by us. Not even if such act or negligence is fraudulent or dishonest.
17-Babs Au pair Agency cannot be held liable for having or bringing an Au pair in the house client in any way.
18-babsaupair Agency have the right to take an Au pair away from the host family if this doesn’t meet the agree condition. Or if the host family has give wrong information when filling out the registration form.
19-Babs Au pair reserves the right to refuse a host family who does not respond within 8 days after applying. The host family is required to inform the Agency within 10 days in writing about the reason of their dissatisfaction.
20-If the Au pair stay in the country for more than 3 months, the Au pair is entitled to one off maximum course contribution of € 240. If the Au pair decide to leaves the family within 6 months, then she has to pay back this amount to the family. If the family ends the contract within 6 months, then the family has to pay for the contribution.

22-Payment
Placement of an Au pair 1-12 months to be paid in the following installments:
22.1 First installment at registration 25% of the placing fee
22.2 Second installments, upon acceptance of au pair file plus interview 50% of placing fee
22.3 Third installment, within 8 days of au pair arrives to the host family 25% of the placing fee.
23-All the prices are exclusion VAT
24-If Babs Au pair agency fee change, the family will be notified
25-During the illness of the Au pair the family has to continue paying the Au pair for a maximum period of 2 weeks.
26-Babs Au pair Agency has the right to refuse a (new) mediation. No appeal possible against this.
27-These terms and conditions shall contracts of agreements (these be usually being a signed”Application form” between the family and the agency). No servant or employee of the Agency has power to vary these terms and conditions save by a notice in writing issued by the Agency and signed by the proprietor.
28.1 On becoming a member or be registered, you agree that some of your details can be displayed on BabsAupair.nl.
28.2 You acknowledge that some of your detail posted by you on Babs Au pair.nl will be able to be accessed by Visitor and Members (photo and little detail about your family).
28.3 We reserve the right to deactivate your account in the event that your contract period has been finish.
29-We reserve the right to vary these Terms & conditions at any time.
Cancellation
30-If the family cancels the mediation and the Au pair hasn’t arrive in the Netherlands yes, but both sides have agree with the mediation, the family has to pay 25% of the mediation fee to Babs Au pair Agency. This payment is for the hours and investment involved. As soon as we have your file, we will process it. Even if waiting time is long, we will thing of you and work on your case.
31-If the au pair cancels the mediation and she hasn’t arrived in the Netherlands yet, but the sides have agree with the mediation, the Babs Au Pair Agency will do his best to mediate as soon as possible for a new Au pair for the family.
32-A claim for refund will not considered by Babs Au pair Agency where the placement of the Au pair has been done. When the full payment has been done, no refund is available of this requested. And also no refund is available when the family make different arrangements during the period when a replacement is been fund by Babs Au pair Agency.
33-cancelling can be done with a valid reason by sending a registered letter.
34-A request for a new mediation can only be made in writing.
